General Terms of Use and Sale

2. Acceptance of terms

You accept these Terms by checking the designated box before saving your program. Simply browsing public pages does not constitute acceptance. If you do not accept these Terms, you cannot create an account or use the authenticated service.

We may update these Terms to reflect legal, technical, or service developments. A material change will be announced before it takes effect via email or within the application. When a new acceptance is legally required, it will be explicitly requested; continued use does not replace it.

3. Saving your program

To save your program, you use a valid email address with a one-time code or, when these options are offered, your Google, Apple, or Microsoft account. These providers serve solely to authenticate you and to create or link your WorkoutGen account.

WorkoutGen is restricted to individuals aged 18 or older. You must confirm you are of legal age before saving a program or subscribing to WorkoutGen Max. An account identified as belonging to a minor will be blocked and then deleted according to our erasure procedure.

You agree to provide accurate information and to keep it up to date. The account is personal and must not be shared.

WorkoutGen sends you the emails necessary to operate your account and the service, including security, login, billing, subscription, legal information, and service continuity messages. Optional communications, such as installation or product-use tips, can be disabled in Settings > Privacy or through the unsubscribe link in these emails.

We reserve the right to refuse or block the creation of an account, notably in the case of a disposable, fake email address or one previously associated with fraudulent use of the service, without having to detail the reason.

4. Plans and pricing

4.1 Free version (WorkoutGen Classic)

WorkoutGen remains usable without a subscription. The free version includes:

• Personalized workout programs, at the gym or at home, with or without equipment, generated by the deterministic engine and methodologically validated by Jeremy Tellier, a state-certified coach
• Exercise library with video demonstrations
• Workout player, rest timer, and workout completion, with logging for weights, reps, and durations, their history, consecutive training weeks, best set, and a 1RM calculator
• Web access from any modern browser, installable as a Progressive Web App on iOS, Android, and desktop
• Offline workout: continue an open workout or start the next workout prepared automatically within the current program month, including after closing and reopening the app. Only one workout can be pending synchronization. An internet connection is required before starting another one. Synchronization is available for ten days from the start of the workout, provided the program has not advanced on another device. After that period, or if the workout cannot be synchronized, your entries can still be recovered by exporting them from the device. Replacing an exercise and modifying the program require an internet connection.
• Choosing a muscle focus for one or more groups when creating your account, available with the muscle gain, toning, and strength goals and retained when regenerating your program, and returning to a balanced program at any time.

4.2 WorkoutGen Max subscription

WorkoutGen Max is optional, and WorkoutGen remains free to use without the subscription. The subscription unlocks the following features:

• Weight or rep suggestions for every set, calculated from your logged performance
• All profile and exercise charts, the complete activity calendar history, and program editing features, such as changing a workout’s format, equipment, or location, or keeping workouts in “My Workouts” to apply them to other days
• AI Coach reviews and performance trend analysis
• The muscle focus, available with the muscle gain, toning, and strength goals: choose one or more muscle groups, up to all but one, and change this choice at any time, for one workout or the entire program. When available, auto distribution adapts the program to work the whole body while prioritizing, for a limited period, the muscle group that is the least-worked group compared with your program. It works when the program is balanced: choosing “Balanced” starts it, and choosing one or more groups stops it. At the end of the subscription, the program keeps its focus, and returning to a balanced program remains possible.
• One voluntary regeneration per account is free; subsequent ones are included in WorkoutGen Max. Initial creation, automatic continuation of cycles, restoration of a missing program, and returning to a balanced program remain free and do not count.

4.3 Pricing

Applicable pricing:

• WorkoutGen can be used for free with its essential workout features.
• The WorkoutGen Max price is displayed at checkout and on the subscription screen.

The total amount, billing period, currency and applicable taxes are shown before payment. The monthly price, crossed-out amount and savings displayed for the annual plan compare it with twelve months of the monthly plan. They are reference points, not payment due dates, and the crossed-out amount is not a former price. Payment is processed by Lemon Squeezy on the web and in the Windows app, and by the App Store or Google Play in the iPhone and Android apps.

4.4 Subscription activation

When you subscribe to Max, payment dates and amounts follow the terms shown before purchase. You can cancel renewal through the service that bills your subscription. Your paid access remains active until the end of the current period.

Max is linked to your WorkoutGen account: wherever you subscribed, it is active on the website and in the iPhone, Android, and Windows apps as soon as you sign in with that account. One subscription is all you need. It must still be managed through the service that bills you.

4.5 Subscription changes

Cancellation takes effect at the end of the current billing period. Data already logged remains accessible after the subscription, and logging weights, reps, and durations remains free.

4.6 Results and projections

The results estimates displayed by WorkoutGen, including the date of your first results and the date when the physique shown in your goal may be achieved, are provided for illustrative purposes. They assume full adherence to the program, with no missed workouts and intensity in line with recommendations, appropriate nutrition, and quality sleep. These are potential initial results, not final results. They vary from person to person based on starting point, health, and consistency, and do not constitute a promise or guarantee of results.

5. Payment and Billing

On our website and in the Windows app, payments are processed by Lemon Squeezy, a service operated by Sold through Link, LLC, as Merchant of Record. The Microsoft Store does not bill Max. Checkout methods may include credit cards, PayPal, and other local methods depending on the country. In the iPhone and Android apps, in-app purchases are processed by the App Store or Google Play, as described below.

Our payment providers encrypt transactions and comply with the PCI-DSS standard.

Subscriptions renew automatically at the end of each billing period unless you cancel. You can cancel your subscription at any time through the service that bills you: go to Settings, then Manage subscription, or, for an App Store purchase, use your Apple account settings.

Invoices for web payments are available in the Lemon Squeezy customer portal, accessible from your account settings. For an in-app purchase, check the purchase history and receipts from the store that charged for the subscription.

For a web purchase, Lemon Squeezy, a service operated by Sold through Link, LLC, is the seller of record for the payment and handles, among other things, the transaction, taxes, and billing. This purchase is also subject to Lemon Squeezy Terms of Sale.

Before paying, the checkout displays the chosen plan, its frequency, its automatic renewal, the total price, the currency, and applicable taxes. You can review and correct the displayed information before confirming an order with an obligation to pay.

After payment is validated, the seller sends you a confirmation and receipt on a durable medium: Lemon Squeezy to the email address entered at checkout, or Apple or Google to the address for your account with them. The contract is concluded when payment is accepted and the confirmation is issued.

Purchases via the iOS App

If you subscribe from the iOS app, the purchase is processed by Apple via the In-App Purchase system. Apple, and not Lemon Squeezy, is then the seller of the payment (Merchant of Record) for this subscription.

Renewal is automatic unless canceled at least 24 hours before the end of the current period, managed exclusively from your Apple account settings (Settings → [your name] → Subscriptions), never from WorkoutGen.

If you no longer have an iPhone or iPad, you can manage the same subscription from any browser at account.apple.com, under Subscriptions.

Our refund policy applies the same rule to all purchases, but for an iOS in-app purchase, Apple is the only party that reviews requests, under Apple's own rules and the rights applicable in the country where you live. You can submit requests at reportaproblem.apple.com. When you submit one, Apple asks us for information about your subscription: you agree that we may provide Apple, through RevenueCat, with your account age, usage time, the service delivery status, and your purchase and refund history, along with our recommendation under this rule. You can withdraw this consent at any time by writing to contact@workoutgen.app. WorkoutGen can help you identify an issue, without guaranteeing Apple's decision or limiting your legal rights.

Purchases through the Android app

If you subscribe through the Android app, the purchase is processed by Google through the Google Play billing system. Google, not Lemon Squeezy, collects payment for this subscription.

Renewal is automatic unless you cancel before the end of the current period. You manage this subscription through Google Play (Play Store → your profile → Payments & subscriptions → Subscriptions), and you can also stop renewal from Settings, then Manage subscription, on the web or in the iOS app. Access remains available until the end of the paid period.

For a Google Play purchase, request a refund from Google Play, which decides and issues refunds according to its rules. This process does not limit your legal rights.

6. Cancellation and Refunds

You can cancel your subscription renewal at any time through the service that bills you. Access remains active until the end of the paid period, unless a refund or another case provided by law or the store applies. WorkoutGen does not offer a commercial “satisfied or refunded” guarantee or refunds as a matter of convenience or on a prorated basis for partially used periods, except where provided for by our refund policy. Mandatory legal rights, terms applicable to a prior purchase, and decisions by the payment provider remain unaffected.

If you are a consumer in the European Union, the European Economic Area, or the United Kingdom, you generally have a 14-day right of withdrawal for a distance purchase, unless a valid legal exception applies. If you withdraw within this period, the refund is full, according to our refund policy. If, when purchasing on our website or in the Windows app, you expressly requested that the service start immediately, a proportional amount for the service already provided remains due where required by law. Our website and the Windows app require this express request before any new purchase following a withdrawal. You can lose this right only in the cases provided by law. For a purchase made on our website or in the Windows app, Settings, then Manage subscription, offers the “Withdraw from contract here” button during these 14 days, and an acknowledgment of receipt is sent to you by email. You can also withdraw through any clear statement sent to contact@workoutgen.app. For an App Store or Google Play purchase, request withdrawal from Apple or Google Play, which decides and refunds according to its terms.

Annual plan purchased on our website or in the Windows app, if you reside in France: we will notify you by a dedicated email, no earlier than three months and no later than one month before the deadline for refusing renewal, that you can choose not to renew it. Otherwise, you can cancel free of charge at any time after renewal, and the portion of the price corresponding to the remaining period will be refunded to you within 30 days (Articles L215-1 to L215-3 and L241-3 of the French Consumer Code).

7. Use of the Service

7.1 Acceptable Use

WorkoutGen is intended for personal use only. You agree to:

• Use the service in accordance with applicable laws
• Do not share your account with others
• Do not copy, reproduce, or distribute the app's content without authorization
• Do not attempt to bypass security measures or access unauthorized features
• Do not scrape or automatically extract generated programs, exercise data, or metadata beyond normal personal use
• Do not use the service or its outputs to reconstruct the generation system, create a competing service, or build a training, evaluation, or benchmarking dataset
• Do not use protected content to train an AI or perform text and data mining without authorization, to the extent that these rights are reserved, unless otherwise provided by mandatory law

7.2 Exercise Disclaimer

WorkoutGen generates recreational fitness programs. If in doubt about a workout or an exercise, seek advice from a qualified professional before continuing.

• You are responsible for knowing your own limits
• Start gradually and progress at your own pace
• Adjust intensity according to your comfort level
• Use proper form for all exercises
• Train in a clear space, on a stable, nonslip surface, especially at home or outdoors

WorkoutGen provides recreational fitness guidance, not medical advice: adapt each workout to your abilities and environment, stop if you experience pain, discomfort, or an unusual symptom, and seek advice from a qualified professional if necessary.

7.3 Results Projections

The app may display illustrations of the physique you could achieve and estimated timelines, such as a date when your first results are expected or a date when the illustrated physique becomes plausible. These visuals are illustrations, and these dates are estimates calculated from your goal, stated level, weekly availability, and the body shape you selected.

These estimates are neither a guarantee of results nor a commitment to a timeline. They assume consistent training, a suitable diet, and sufficient rest. Your actual progress depends on individual factors that the service does not measure, including your health, sleep, diet, and training history.

8. Intellectual Property

WorkoutGen is the proprietary software product of JCODE, which exclusively publishes and operates it. No ownership rights in WorkoutGen are transferred to the user. The original source code, text, audiovisual works, interface design, and the protectable selection, organization, and arrangement of WorkoutGen content are subject to rights held by their respective owners or licensed by JCODE, and are protected under applicable law. Ideas, methods, features, and algorithms are claimed only to the extent protected by law.

A limited, non-exclusive, and non-transferable license is granted to you to access the app and use your generated program for your personal training. Any commercial reuse, publication, reproduction, or modification requires prior written authorization, subject to mandatory legal rights.

JCODE expressly reserves, within the limits permitted by law, the rights to the protected selection and arrangement of its databases as well as text and data mining rights. Mandatory legal exceptions remain applicable.

Apart from their normal viewing within the Service and mandatory legal exceptions, photographs, images, and videos produced or filmed for WorkoutGen, as well as their still images, clips, soundtracks, thumbnails, and sequences, may not be extracted, copied, recorded, republished, embedded, cropped, edited, modified, synchronized, broadcast, resold, used in an advertisement, product, or service, incorporated into a dataset, or used to train, evaluate, or feed an artificial intelligence system without the prior written authorization of the rights holder or JCODE when authorized to grant it.

Without the prior written authorization of the rights holder or JCODE when authorized to grant it, decompilation, disassembly, reverse engineering, and reconstruction of the source code or protected structure of the software are prohibited, including from the Service's outputs, subject to mandatory legal exceptions.

These restrictions do not prohibit acts that the law mandatorily permits, including necessary backup copying, lawful observation, study, or testing of the software's operation or security, as well as acts essential to interoperability under the conditions of Article L.122-6-1 of the Intellectual Property Code. Unprotected ideas and principles, third-party component licenses, and the legitimate reporting of a vulnerability in accordance with our security policy remain unaffected.

10. Digital Guarantee and Liability

JCODE uses reasonable means to keep WorkoutGen accessible and compliant with its description. However, interruptions due to maintenance, network issues, or service providers may occur. Legal guarantees applicable to digital content and services remain fully applicable.

JCODE is liable for direct and foreseeable damages caused by a breach attributable to it. JCODE is not liable for damage caused exclusively by improper use of the service, a defect in your device or connection, or an external event that it could not reasonably control.

No clause in these Terms excludes or limits liability that cannot be legally excluded or limited, notably in cases of willful misconduct, gross negligence, personal injury attributable to JCODE, or the application of a legal guarantee. Any other limitation applies only to the extent permitted by law.

For a lack of conformity of WorkoutGen Max, consumers benefit from the statutory warranty throughout the period of continuous supply. They may request that the service be brought into conformity at no cost. In cases provided by law, including refusal, impossibility, unjustified delay, or major inconvenience, they may obtain a price reduction or terminate the contract. Write to contact@workoutgen.app; JCODE coordinates the request with the seller that billed you, Lemon Squeezy, Apple, or Google Play, without preventing you from pursuing a direct remedy against that seller.

11. Termination

You can delete your account at any time from the app's Settings. Deletion is permanent and erases the service data, subject to the limited retention described in our Privacy Policy, including billing obligations and abuse prevention.

Deleting your account does not cancel a subscription billed by Apple or Google Play: you will continue to be charged until its renewal is turned off. A subscription purchased on our website or in the Windows app must be canceled before deleting your account.

After deletion, one initial recreation is possible immediately. Any further recreation will then be possible only 30 days after the previous successful recreation, for login identities that we already know are linked. This waiting period never prevents you from deleting your account and does not cancel or suspend a subscription. Restoring a purchase on a new account requires that you be able to recreate that account. If you have difficulty, contact contact@workoutgen.app.

We reserve the right to suspend or delete your account in the event of:

• Violation of these Terms
• Fraudulent use of the service
• Abusive behavior toward our team or other users
• Non-payment of amounts due

In the event of termination for serious breach, no refund is in principle provided, without prejudice to mandatory legal rights.

12. Modifications to the Service

We may evolve, suspend, or discontinue a feature for technical, legal, or security reasons. Any substantial modification to a paid service will be announced on a durable medium within the required timeframe and does not reduce legal rights to termination, compliance, or refund.

Prices offered for new purchases may change. If a change is to affect the renewal of an existing subscription, it will be notified in advance and will only apply according to the legally applicable process and conditions; you can cancel before renewal.

13. Applicable Law and Jurisdiction

These Terms are governed by French law. Mandatory consumer protection rules of your country of residence remain applicable when legally required.

Any dispute relating to these Terms may first be submitted to our support team for an amicable resolution. If no amicable solution is reached, the dispute may be brought before the competent courts under applicable law, including mandatory consumer jurisdiction rules.
